泰国部分劳工法规
1. Child Labor and Young Worker 童工及未成年工
Child Labor 童工
Requirement: According to The Labor Protection Act B.E.2541 Chapter 4 Section 44,
Indicated thatan employer shall not employ a child under fifteen years of age as an employee.
泰国劳工保护法佛历二五四一年 (公历一九九八年) 第四篇第四十四条:
禁止雇主聘雇年龄小于15岁的儿童作童工。
Young worker notification 未成年工登记
Requirement: According to the Labor Protection Act B.E. 2541 Chapter 4 Section 45
: In case of employment of a young worker under 18 years of age, the employer shall
comply with the following: (1)notify a Labor Inspector regarding the employment of a young worker within 15 days of the young worker commencing work;
(2)prepare a record of employment condition in case of a change taken place to be
kept at the place of business or at the office of the employer available for inspection
by a Labor Inspector during working hours; and
(3)Notify the Labor Inspector regarding the termination of employment of a young
worker within 7 days from the date of young worker being dismissed.
The notification or the record under paragraph one shall be in accordance with the forms
prescribed by the Director-General.
泰国劳工保护法佛历二五四一年 (公历一九九八年) 第四篇
第四十五条:若雇主聘雇18岁以下的未成年工,须执行下列法规:
(一)自未成年工开始工作后的15天内,雇主要将实情呈报给劳工检查员。
(二)需记录聘雇的变化情况,并将记录保存在雇主的办公室或工作场所内,以方
便劳工检查员可在正常工作时间内随时检查。
(三)若结束聘雇未成年工,需在该未成年工正式辞职后 7天内,汇报给劳工检查员。
上述之记录与汇报必依劳工部规定之作业格式进行。
Young worker works overtime or on a holiday 未成年工加班或假日上班
Requirement: According to the Labor Protection Act B.E. 2541 Chapter 4 Section 48:
An employer shall not require a young worker under 18 years of age to work overtime
or to work on a holiday.

第四十八条:禁止雇主要求年龄小于 18岁的未成年工加班或在假日内工作。
Young worker works at 22:00 to 06:00 未成年工工作时间限制
Requirement:
According to The Labor Protection Act B.E.2541, Chapter 4 Section 47 An employer is prohibited from causing a child employee under the age of 18 to work between 10:00pm and 6:00am, except where written permission has been granted by the Director General or his designate.
泰国劳工保护法佛历二五四一年 (公历一九九八年) 第四篇第四十七条:禁止雇主要求年龄低于18
岁以下的未成年工在夜间 22.00时至06.00时工作,除非已获得了劳工厅厅长或其委托人亲笔签名的同意书。
2. Minimum Wage: 最低工资
Minimum Wage 最低工资
Requirement:According to the Labor Protection Act BE.2541 Chapter 6 Section :90 After
the announced minimum wage officially be effective, no employer is allowed to pay wage below the legal minimum wage standard to its employees.
泰国劳工保护法佛历二五四一年 (公历一九九八年) 第六篇第九十条:当公布的最低工资正式生效后,禁止雇主支付低于所规定的最低工资给雇工。
3. Overtime Wage: 加班费
Overtime Wage for Working Days 工作日加班工资
Requirement:According to the Labor Protection Act BE. 2541 Chapter 5 Section 61:Whereas an employer requires an employee to work overtime on a working day, the
employer shall pay overtime pay to the employee at a rate of not less than one and a
half times of the hourly wage rate of a working day for the number of hours of work
done, or, where an employee receives wages on a piece rate basis, not less than one
and a half times of the piece rate of wages of a working day for work done.
泰国劳工保护法佛历二五四一年 (公历一九九八年) 第五篇第六十一条:
若雇主要求雇工在平常工作日内加班,则加班费应不少于正常工作日平均时薪的1.5倍,若计件雇工则以平日每件所得工资的 1.5倍来计算。
Overtime Wage for Holidays under section 28, section 29 or section 30 假日加班工资
Requirement: According to the Labor Protection Act BE. 2541 Chapter 5 Section 62 (2)
: Whereas an employer requires an employee to work on a holiday under section 28,
section 29 or section 30, the employer shall pay holiday pay to the employee at the
following rates:
(1)For the employee who is entitled to receive basic pay on holidays, an
additional amount of not less than one multiple of the hourly basic pay rate
earned per hour on normal working day, or not less than one multiple of the rate
of basic pay per unit of output earned per unit on a normal working day for an
employee who is paid on the basis of output;
(2)For the employee who is not entitled to wage on holiday, the payment shall be
made for not less than 2 time of hourly paid wage on working days according to
hour of wage; or not less than 2 time of wage per piece on working days
according to the piece of work done by the employee who receives wage on a
piece-work basis.

若雇主要求雇工在按照第二十八条,第二十九条,第三十条法律所规定的假日上班时,则雇主须按照下列原则来支付假日工作费给雇工:
(一)对于有权获得假日工资的雇工,雇主必再增发每小时不少于平时工作日的1倍工资给雇工,对于计件的雇工,则雇主要增发不少于平时计件的1倍工资给计件的雇工。
(二)对于平时在假日无权领薪的雇工,若在假日工作时,则雇主必以不少于平时工作日平均时薪的2
倍工资来支付给雇工。至于计件的雇工,则雇主要以不少于平时计件所得工资的 2倍工资来支付给计件的雇工。
Overtime Wage for Holiday 假日超时加班工资
Requirement: According to the Labor Protection Act B.E. 2541 Chapter 5 Section 63
Where and employer requires an employee to work overtime on a holiday, the employer
shall pay holiday overtime pay on holidays to the employee at not less than treble
the hourly basic pay rate earned per hour on a normal working day, or not less than
treble the basic pay rate earned per unit on a normal working day per unit of output
for an employee who is paid on the basis output.
泰国劳工保护法佛历二五四一年 (公历一九九八年) 第五篇第六十三条:
若雇主要求雇工在假日中超时加班,则雇主需支付每小时不少于正常时薪的 3倍加班费,或不少于平日计件薪水的 3倍工资给计件雇工。
No Need Pay Overtime Wage 可以不支付加班费的情况
According to the Labor Protection Act BE. 2541 Chapter 5 Section 65: An employee who is authorized or assigned by an employer to perform any of the following work shall not be entitled to overtime pay under section 61 and holiday overtime pay under section 63
, but an employee required by the employer to
perform work according to (3), (4), (5), (6), (7), (8), or (9) below shall be entitled to
receive remuneration in money equivalent to hourly wage rate of a working day for
the number of hours of work done:
(1)an employee who is authorized to act on behalf of the employer in regard to the employment, granting of gratuities, reduction of wages, or termination of employment;
(2)Selling or promote sale of products, and employer had paid payment to middleman for the employees.
(3)railway service operate, ie. Work done on a railway carriage and work facilitated for railway transportation;
(4)opening or closing of Watergates or spillway;
(5)recording of water levels and measuring quantities of water;
(6)fire fight or public disaster prevention;
(7)work which by its nature or conditions has to be done outside of premises and where the definite working time may not be fixed;
(8)guarding or caretaking of premises or property which is not a regular duty of
an employee; or
(9)other work as prescribed in the Ministerial Regulations. Unless the employer agrees to pay overtime pay or holiday overtime pay to employee.
泰国劳工保护法佛历二五四一年 (公历一九九八年) 第五篇第六十五条:以下雇主安排雇工去执行的工作,雇工无权领取第六十一条规定的加班费,及第六十三条规定的假日加班费,但第(三)、(四)、(五)、(六)、(七)、(八)或(九)项的工作可领取与正常工作日时薪相同的时薪来计算的
工资。
(一)有权替雇主处理聘雇、发放退休金、结束聘雇等工作的雇工。
(二)行售或推推销卖产品,且雇主已付其工资给雇工的中介人。
(三)安排火车正常运行的工作,包括火车上的工作及提供火车运行方便的工作。
(四)打开及关闭水闸或排水门的工作。
(五)观察水位和测量水容量的工作。
(六)灭火工作或防备对大众产生危险的工作。
(七)工作性质或类型属外勤,且无法明确规定其工作时间。
(八)看守工作场所或看守非责任所在的财产工作。
(九) 按照劳工部条例所规定的其它工作。
上述所列的类工作,若雇主决定支付加班费或假日加班费给雇工则例外,即可不受此条法律的限制。
4. Overtime Hours: 加班时间
Normal working hour violation 正常工时不合规
Requirement: According to the Labor Protection Act B.E. 2541 Chapter 2 Section 23 An
Employer shall notify a normal working time to an employee, by specifying the commencing and ending time of work in each day of the employee, which shall not exceed the working time for each type of work as prescribed in the Ministerial Regulations and not exceed eight hours per day. Where the working hours of any day are less than eight hours, the Employer and the employee may agree to make up the remaining working hours in other normal working days, but not exceed nine hours per day and the total working hours per week shall not exceed forty-eight hours. Except for the work which may be harmful to health and safety of the employees as prescribed in the Ministerial Regulations for which the normal working hours shall not exceed seven hours per day and the total working hours per week shall not exceed forty-two hours.
泰国劳工保护法佛历二五四一年 公历一九九八年) 第二篇 第二十三条:
雇主须向雇工公布正常工作时间,列明雇工的每天上班时间和下班时间,按照法律规定不超出该类工作的工作时间,基本上每天工作应不超过 8 个小时,每周累计不应超过 48 个工时,雇主与雇工可以共同决定将超出的工作时间去计算在正常工作日里,但每日不该超过 9 小时,每周合计不超过 48 小时,唯法律规定对身体健康及安全有问题的工作类型,则每天工作时间不应超过7个小时,每周累计不逾42个小时。
No work on Holiday 禁止假日加班
Requirement: According to the Labour Protection Act BE.2541 Chapter 2 Section 25 An employer shall not require an employee to work on a holiday unless the character or
nature of work requires it to be performed continuously and stoppage may cause damage to the work, or it is emergency work. In that case, an employer may require an employee to work on a holiday as necessary.
泰国劳工保护法佛历二五四一年 公历一九九八年() 第二篇 第二十五条:
禁止雇主要求雇工在假日工作,除非是紧急工作或其工作性质不能停止,否则会造成损失,遇情况可允许下雇主可在假日以适当的时间令雇工上班。
No Rest One Day per Week 每周未有一天休息
Requirement: According to the Labour Protection Act BE.2541 Chapter 2 Section 28: An
employer shall provide a weekly holiday of not less than one day per week for an Employee, and the interval between weekly holidays shall be not more than six days.
泰国劳工保护法 佛历二五四一年 公历一九九八年() 第二篇 第二十八条:雇主必安排雇工每周均有假日,一周中的假日不能少于 1天,每周的例行假日期间,相隔不能超过 6天。
泰国劳工保护法 佛历二五四一年(公历一九九八年) 第七篇 第九十六条:
若营业机构里有超过50名以上的雇工人数,则雇主必须成立营业机构里的福利委员会,其委员须包括至少5名的雇工代表。营业机构里的福利委员会每位委员必来自福利厅所规定的原则和方法所选举
而得。
